These Terms of Service constitute a legally binding agreement between you and LoveaLocal. By accessing or using our platform, you acknowledge that you have read, understood, and agree to be bound by these terms.
1. Acceptance of Terms
By accessing or using LoveaLocal, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site. These terms apply to all users, including customers, vendors, and experience hosts.
2. Description of Service
LoveaLocal is a platform that connects food lovers with local vendors and experience hosts. We facilitate two types of services: (a) Food Delivery - ordering prepared meals from local vendors for delivery or pickup; and (b) Culinary Experiences - booking cooking classes, food tours, and dining experiences hosted by local chefs.
3. User Accounts
Registration
To use certain features of our service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
Account Responsibility
You are responsible for safeguarding the password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
Account Termination
We reserve the right to suspend or terminate your account and refuse any and all current or future use of the Service for any reason at any time, including if you violate these Terms.
4. Vendor Terms
Vendor Registration
To list food items or experiences on LoveaLocal, you must register as a vendor. We verify all vendors to ensure quality and authenticity. Vendors must be at least 18 years old and legally authorized to operate a food business.
Menu and Pricing
Vendors are responsible for maintaining accurate menu information, pricing, and availability. All prices should be inclusive of applicable taxes unless otherwise stated.
Food Safety
Vendors must comply with all applicable food safety regulations, including FSSAI requirements. LoveaLocal reserves the right to remove any vendor that fails to maintain proper food safety standards.
Experience Hosting
Experience hosts must ensure the safety of all participants and provide accurate descriptions of their experiences. Hosts are responsible for obtaining any necessary permits or insurance.
5. Orders and Payments
Order Placement
When you place an order, you are offering to purchase the selected food items or book the selected experience. Orders are confirmed when you receive a confirmation from us.
Pricing
All prices are listed in Indian Rupees (INR) and include applicable taxes unless otherwise stated. Prices are subject to change without notice.
Payment Processing
Payments are processed securely through our payment partners. We accept various payment methods including credit/debit cards, UPI, and cash on delivery (where available).
6. Cancellations and Refunds
Cancellation and refund policies vary depending on the type of order and vendor. Please refer to our Refund Policy for detailed information about cancellations, refunds, and the refund process for different payment methods.
7. User Conduct
Prohibited Activities
You agree not to: (a) use the service for any illegal purpose; (b) harass, abuse, or harm another person; (c) impersonate any person or entity; (d) interfere with or disrupt the service; (e) attempt to gain unauthorized access to our systems.
Reviews and Content
You may post reviews and comments, but you are solely responsible for the content you post. We reserve the right to remove any content that violates these terms or is otherwise objectionable.
8. Intellectual Property
The LoveaLocal name, logo, and all related content, features, and functionality are owned by LoveaLocal and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written consent.
9. Limitation of Liability
To the maximum extent permitted by law, LoveaLocal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the service; (ii) any conduct or content of any third party; (iii) any goods or services obtained through the service.
10. Indemnification
You agree to indemnify and hold harmless LoveaLocal and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the service.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai.
12. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
